Renovo Software Privacy Policy

The practices of Renovo Software, Inc., a Minnesota corporation ( "Renovo Software," "we," or "us"), in dealing with users of the Site, the Software and the Services of Renovo Software are governed by this Privacy Policy ("Privacy Policy"), as amended from time to time, which can be found in its most current version at www.renovosoftware.com. Any information collected or maintained by Renovo Software that identifies or can be used to identify you including Personally Identifiable Information will automatically be subject to this Privacy Policy. This Privacy Policy is a part of, and is incorporated into, the Renovo Software Terms of Use between you and Renovo Software. This Privacy Policy and the End User License Agreement (together, the "Agreement") comprise the entire agreement and understanding between you and Renovo Software with respect to the privacy policies of Renovo Software and your use of the Site, the Software and the Services.

PLEASE REVIEW AND PRINT THIS PRIVACY POLICY REGULARLY. If you have objections to this Privacy Policy, you should immediately discontinue any and all use of the Site, the Software and the Services.

Please note that this privacy policy applies only to information collected by Renovo Software in connection with your use of the Software and the Services. This Privacy Policy does not apply to any data collected by Renovo Software from you in the context of other separately operated or provided Renovo Software products or services.

  1. Notice and Consent to Intercept, Record and Share Content and Conferences
    1. Unless you have been registered and accepted as a visitor with the right to encrypted visitation, you acknowledge and consent that in order to participate in a Conference with an incarcerated participant the Participating Facility will intercept, monitor and record the visual and audio Content and the Conference. The Site, Services and Software specifically allow the Participating Facility to intercept, monitor and record the Content and the Conference. The Participating Facility will also be a participant of the Conference and intended recipient of any Content thereof. The ability of the Participating Facility to intercept, monitor and record the Content and the Conference is a requirement of the Participating Facility's contract with Renovo Software and is therefore necessary to construct, maintain, conduct and operate the Site, Services and Software.
    2. The laws of some jurisdictions require the giving of notice to, or receipt of consent from, individuals prior to intercepting, monitoring and/or recording the contents of a communication and sharing Personally Identifiable Information, and/or that a subscriber may request to have their electronic mail address or other Personally Identifiable Information kept Professional.
    3. YOU HEREBY ACKNOWLEDGE AND CONSENT THAT YOUR PERSONALLY IDENTIFIABLE INFORMATION AND BOTH THE AUDIO AND VISUAL COMPONENTS OF ALL CONTENT AND CONFERENCES WILL BE INTERCEPTED, MONITORED, RECORDED AND USED BY THE PARTICIPATING FACILITIES AND/OR RENOVO SOFTWARE. YOU ACKNOWLEDGE THAT THERE IS NO EXPECTATION OF PRIVACY OF ANYONE PARTICIPATING IN THE CONFERENCE, ANY CONTENT OF A CONFERENCE OR ANY PERSONALLY IDENTIFIABLE INFORMATION REQUIRED TO PARTICIPATE IN ANY CONFERENCE.
    4. UNLESS YOU HAVE BEEN REGISTERED, AND ACCEPTED, AS A PROFESSIONAL VISITOR, YOU HEREBY AUTHORIZE THE PARTICIPATING FACILITY AND/OR RENOVO SOFTWARE TO INTERCEPT, MONITOR, RECORD, REPRODUCE, COPY, DISPLAY, TRANSMIT, UPLOAD, DOWNLOAD, MODIFY, MAINTAIN AND PUBLISH ANY CONTENT, INCLUDING ANY AUDIO AND VISUAL CONTENT OF ANY CONFERENCE, AND YOUR PERSONALLY IDENTIFIABLE INFORMATION. YOU HEREBY AUTHORIZE RENOVO SOFTWARE AND THE PARTICIPATING FACILITY TO STORE AND SHARE SUCH INFORMATION WITH THIRD PARTIES INCLUDING, WITHOUT LIMITATION, ITS AFFILIATES, MARKETING PARTNERS, GOVERNMENTAL AND/OR LAW ENFORCEMENT PERSONNEL, WITHOUT THE NEED FOR A SUBPOENA, WARRANT, COURT ORDER OR AUTHORIZATION FROM YOU.
    5. YOU HEREBY RELEASE AND COVENANT NOT TO SUE RENOVO SOFTWARE, ITS AFFILIATES AND ANY PARTICIPATING FACILITY FROM ANY CIVIL CLAIM OR CRIMINAL COMPLAINT RELATED TO SUCH INTERCEPTION, MONITORING, AND RECORDING OF ANY CONTENT OF ANY CONFERENCE, ANY PERSONALLY IDENTIFIABLE INFORMATION, AND ANY SUBSEQUENT USE, PUBLICATION OR SHARING THEREOF, INCLUDING, WITHOUT LIMITATION, ANY STATE OR FEDERAL WIRETAP, EAVESDROPPING, STORED COMMUNICATIONS, OR INVASION OF PRIVACY STATUTES, TITLE III OF THE OMNIBUS CRIME CONTROL AND SAFE STREETS ACT (18 USC §§2510-2521), 18 USC §§2701 - 2720, Nevada Revised Statute §§200.610 - 200.690, California Penal Code §§ 630 - 637.9, AND ANY SIMILAR OR RELATED ACTS OR CLAIMS.
    6. If you are a Professional Visitor and require visits to be encrypted so as to eliminate the possibility for interception, monitoring and recording, you must register with, and be accepted as a professional visitor with encryption rights by the Participating Facility and register as such on the Site prior to your Conference. Upon acceptance as a visitor with such rights by the Participating Facility, and registration on the Site as a Professional Visitor, the Conference between a Visitor and the incarcerated at the Participating Facility will not be recorded and the consent, releases and waivers in Sections 1(a-e) shall not apply. However, if you participate in a Conference prior to the time of being accepted by the Participating Facility as a Professional Visitor with encryption right, and registering as such on the Site, you hereby consent to the interception, monitoring, recording and use of all Personally Identifiable Information, Conferences and Content within such Conferences as set forth in Sections 1(a-e) above and all releases set forth in Sections 1(a-e) above shall apply. In addition, if you are a Professional Visitor and any Content of a Conference is inadvertently being recorded, and such notice of recording is being displayed during a Conference, or you know the Conference is being recorded, you will be deemed to no longer have an expectation of privacy within such Conference and shall be deemed to have consented to the interception and recording of such Conference and content and shall be deemed to have released Renovo Software, its Affiliates and any Participating Facility to the same extent as set forth in Sections 1(a-e) above.
  2. Collection of Your Personally Identifiable Information
    Following is a summary of the ways in which we collect and use Personally Identifiable Information.
    1. As a visitor to the Site, you may browse the publicly-accessible areas of the Site and engage in certain activities without providing any Personally Identifiable Information to Renovo Software. Access to the Software, the Services and the ability to participate in a Conference may be obtained only after you register with Renovo Software which will require you to provide certain Personally Identifiable Information. It is optional for you to engage in these activities. If you elect to engage in these activities, however, you will be deemed to have consented to our collection and use of your Personally Identifiable Information in accordance with this Privacy Policy. The Personally Identifiable Information that you may be asked to provide may include your full name, address, e-mail address, driver's license number, telephone number, payment information and any other identifier that permits the physical or online contacting of you or Personally Identifiable Information that is gathered from your computer and you during your use of the Site, the Software and the Services. When ordering Services via the Site, you will also be asked to provide a credit card number. The credit card details that you provide when ordering the Services constitute Personally Identifiable Information that is covered by this Privacy Policy.
    2. We may also collect certain information about your access to and use of the Site, the Software and the Services, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet, the dates and times that you access the Site, the Software and the Services, the pages that you view while at the Site, and the Internet address of the website from which you linked to the Site. Information regarding your computer system configuration and operating system is also gathered. This information is used by us to identify you and to help analyze trends and to improve and administer the Services. Please be aware that when you provide Personally Identifiable Information in a posting on any electronic forum, including any Conference, that information is available to anyone else using or participating in that forum. For this reason, we strongly discourage you from offering any Personally Identifiable Information within a posting to any forum, including any Conference, unless you wish to disclose such Personally Identifiable Information to all users of the forum, including all participants in the Conference and third parties with whom those users or participants in the Conference may share your Personally Identifiable Information at the time of the Conference or later on.
    3. The Services incorporate Error Logging and Reporting ("ELR") that captures error report data and, at your option, sends this data to Renovo Software via the Internet. Error report data is used to assess and correct errors or problems that may occur during use of the Site, the Software and the Services. ELR error reporting is automatically triggered when the Service detects a software error. You will be asked for your consent before ELR error reports are sent to Renovo Software. ELR error reports collect information about what the Software was doing when it experienced the problem and about your machine's configuration. It is possible that ELR error reporting may collect Personally Identifiable Information, business information or other information as part of the error report. For example, a snapshot of memory may include your name, portions of documents that you were viewing or sharing during the Conference in which the error occurred, portions of any presentation that you were viewing or sharing during the Conference in which the error occurred or application or desktop data that you were viewing or sharing during the Conference. If you are concerned that the ELR error report may contain Personally Identifiable Information or other information that you do not want to disclose, please do not send us the ELR error report.
    4. In order to improve our Site, we may use "cookies" or other tools to track your visit. A cookie is a small amount of data that is transferred to your browser by a web server and can only be read by the server that gave the cookie to you. Most browsers are initially set to accept cookies. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. For some web pages that require an authorization, cookies are not optional. Users choosing not to accept cookies may not be able to access those pages. If you choose to decline cookies, you may not be able to use interactive features of the Site or other websites that depend on cookies. One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page, or navigate within a website, a cookie helps the website recall your specific information on subsequent visits. This simplifies the process of delivering relevant content to you and eases website navigation. When you return to the same website, the information you previously provided can be retrieved so you can easily use the website's features that you have customized. Some of these cookies may be placed by third party service providers to help determine the effectiveness of our advertising campaigns or e-mail communications. Doing this allows the service provider to recognize your computer each time you visit certain pages or websites and to compile certain anonymous information in relation to those page views and report aggregate page view and advertising statistics. In addition to cookies, the Site automatically logs the IP/Internet address of your computer, your browser version, referring URLs and general web visitor information used by our web traffic reporting tools. This information may be linked to your registration information, and your navigation around the Site may be tracked. We use this information to understand how the Site is being used so that we can improve the Site and offer appropriate products and services to our customers. For example, the Site may contain electronic images known as web beacons (an object that is embedded in a web page or e-mail and is usually invisible to the user but allows confirmation that a user has viewed the page or e-mail, also called web bugs or single-pixel gifs), other coded image files, or private entry pages (pages with no other links from the Site) that allow Renovo Software to count users who have visited those pages. Renovo Software may include these types of counting devices in its web pages, e-mails and other electronic materials in order to count traffic or determine readership statistics.
    5. If your use of and access to the Site, the Software and the Services includes password-restricted access to your sensitive information (such as, for example, customer lists and contractual terms), then by accessing or using the Site, the Software and the Services and setting up an account, you consent to the display and storage of such information by Renovo Software and accept all risks of unauthorized access to such information.
  3. Security of your Personally Identifiable Information
    1. Renovo Software uses industry standard Secure Socket Layer (SSL) encryption on all Log In Information you input as well as on other Personally Identifiable Information. This process encrypts your information before you send it over the Internet to us. Although this greatly reduces the risk of your information being compromised, no security method available is 100% guaranteed and we make no warranty that your information will not be intercepted and you acknowledge and agree that we are not responsible, in any manner whatsoever, for any damages arising from any such interception of information.
    2. Any information (including without limitation Personally Identifiable Information) that you post to a public bulletin board, blog, chat room or Conference is available to all persons accessing that location. The information you share in such venues (including without limitation Personally Identifiable Information) is also available to all persons accessing such venues, and such information may be read, collected or used by others for any purpose, including sending you unsolicited messages. Renovo Software is not responsible for any information that you elect to submit in these venues or for any use of such information by any party. YOU HEREBY RELEASE AND COVENANT NOT TO SUE, OR OTHERWISE MAKE ANY CLAIMS AGAINST, RENOVO SOFTWARE, ITS AFFILIATES AND ANY PARTICIPATING FACILITY FOR ANY DAMAGES OR LOSS ARISING FROM OR RELATED IN ANY MANNER WHATSOEVER TO THE DISCLOSURE OF INFORMATION, INCLUDING WITHOUT LIMITATION PERSONALLY IDENTIFIABLE INFORMATION, THAT YOU PROVIDE TO RENOVO SOFTWARE IN A NON-SECURE MANNER, SUCH AS BY E-MAIL FAX, IN A CONFERENCE, IN CONTENT OR OTHER NON-SECURE METHODS.
  4. Use of Personally Identifiable Information
    1. Your Personally Identifiable Information collected on the Site will be used to provide the ability to participate in a Conference and to use the Site, the Software and the Services by you and the Participating Facility. In support of these uses, you consent to the disclosure of your Personally Identifiable Information to any Participating Facility, law enforcement officer or governmental investigative personnel without the need for a subpoena, warrant or court order or further authorization from you. In addition, Renovo Software, its Affiliates and/or Participating Facilities may disclose Personally Identifiable Information if required to do so by law, or if Renovo Software, its Affiliate and/or a Participating Facility believes in good faith that such action is necessary:
      1. to comply with any law, regulation, or litigation; or
      2. to protect and defend the property rights of Renovo Software and its Affiliates; or
      3. to act in urgent circumstances to protect the personal safety of any officer, director, employee, consultant, agent or representative of Renovo Software or any Affiliate, any user of Renovo Software products or services including without limitation the Site, the Software or the Services, or any member of the public; or
      4. for reasons of security, law enforcement or other issues of public importance.
    2. Your Personally Identifiable Information collected on the Site will be used to provide you with more effective customer service, to improve the Site, the Software and the Services, and to make the Site easier to use by eliminating the need for you to repeatedly enter the same information or by customizing the Site to your particular preference or interests, among other uses.
    3. You acknowledge and agree that Renovo Software may receive, share and transfer information arising from your use of the Site, the Software and the Services (including without limitation Personally Identifiable Information), whether arising from Conferences or otherwise, with relevant service providers such as licensors, Affiliates, sponsors, partners, collection agencies, Participating Facilities, telecommunications providers and government entities. You agree that Renovo Software shall bear no liability to you for any such receipt, sharing or transfer and hereby release Renovo Software, its Affiliates and Participating Facilities from any claim arising therefrom.
    4. You acknowledge and agree that the Renovo Software Site and Software allows Renovo Software to obtain and record information about your contacts, your computer use, and your presence at your computer at any given time, among other information, and that Renovo Software can utilize and maintain this information for its own use and to provide marketing communications to you. Notwithstanding any communications preferences indicated by you in connection with your creation of Log-In Information or otherwise, you agree that Renovo Software may contact you regarding the Site, the Software and the Services. Renovo Software shall be entitled to use your Personally Identifiable Information including, without limitation, the identity of third parties with whom you communicate using the Site, the Software and the Services. By way of example and without limiting the foregoing, Renovo Software may contact you and any such third parties to provide information, to offer its products and services, and to solicit comments and feedback regarding the Site, the Software and the Services, and Renovo Software may send frequent e-mail communications to you and to such third parties for various marketing purposes, including to offer a free trial to such third parties.
    5. Neither Renovo Software nor its Affiliates will sell your Personally Identifiable Information to third parties or otherwise make it available to third parties, except as set forth in this Privacy Policy or as permitted by you through an opt-in permission request. However, in the event that Renovo Software (or any Affiliate that is not an individual) sells its assets to another entity, or Renovo Software (or any Affiliate that is not an individual) is acquired by or merged with another entity, you agree that Renovo Software or such Affiliate may provide your Personally Identifiable Information to the purchaser and its representatives in connection with any such sale acquisition or merger without obtaining your consent. Renovo Software will post a notice of any such asset sales, acquisitions, or mergers on the Site, if and when consummated.
    6. The Site, the Software and the Services are generally intended for adult audiences. Renovo Software does not knowingly collect, disclose or use any Personally Identifiable Information of individuals under 13 years of age for marketing, solicitation or any other purposes, other than for lawful purposes related to the operation and maintenance of the Site, the Software and the Services or as required by law.
  5. Miscellaneous
    1. Updating Your Personally Identifiable Information - A link on the Site allows you to amend your profile and correct or update your Personally Identifiable Information. It is your responsibility and obligation to keep all of your Personally Identifiable Information on file with Renovo Software current at all times.
    2. Links to Other Web Sites - The Site may contain links to third party websites. This Privacy Policy applies solely to the Site and to the information collected by the Services. You acknowledge and agree that Renovo Software is not responsible for the privacy practices or the content of third party websites, for your use of any third party websites, or for any intended or unintended consequences of such use. We encourage you to be aware when you are leaving the Site and to read the privacy statements of each and every other website that you visit before providing any Personally Identifiable Information.
    3. Amendments - Renovo Software may, at any time, and in its sole discretion, amend the provisions of the Privacy Policy by publishing the revised Privacy Policy on the Site. You hereby authorize Renovo Software to automatically access, install and otherwise provide updates and Amendments from time to time, without further notice to you or need for consent from you. The Privacy Policy shall automatically incorporate and include any and all amendments, modifications, supplements or updates thereto ("Amendments"). The Amendments shall become effective immediately upon such publication. Your access and use of the Site will be subject to the most current version of the Privacy Policy. You are encouraged to visit the Privacy Policy links on the home page of the Site each time you access and/or use the Site and to print the same for your records. You expressly accept the Privacy Policy and Amendments thereto by accessing and/or using the Site and participating in any Conferences related thereto.
    4. Renovo Software Contact Information - If you have questions regarding this Privacy Policy, or if you believe this Privacy Policy has not been complied with, please contact Renovo Software by either (1) certified mail, return receipt requested; or (2) USPS, UPS or Federal Express overnight courier with delivery signature required, in either case addressed to the principal place of business indicated on the Site, to the attention of the President. Please include the word "privacy" in the subject. You may also contact us through postal mail at the address found in the "Contact Us" section on the Site. In your correspondence, please ask your question in detail or describe in detail the ways in which you believe that the Privacy Policy has not been complied with. We will investigate your question or concern and will use commercially reasonable efforts to promptly provide an answer or otherwise to determine and remedy the problem.
    5. Releases and California Disclosures - IF YOU ARE A CALIFORNIA RESIDENT YOU HEREBY WAIVE THE APPLICATION TO YOU OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF NOT KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR." IF YOU ARE NOT A CALIFORNIA RESIDENT, YOU HEREBY WAIVE ANY APPLICABLE LAW THAT IS SIMILAR TO CALIFORNIA CIVIL CODE SECTION 1542.
      In addition, due to Section 1798.83 of the California Civil Code, if you are a California Resident and a customer of Renovo Software, you have the right to request information regarding how Renovo Software shares or has shared your Personally Identifiable Information with third parties for the third parties' direct marketing purposes during the preceding calendar year, and a list of all third parties that received your Personally Identifiable Information and examples of the products or services marketed by such third parties if the nature of the third parties' business cannot reasonably be determined from their name.
    6. Entire Agreement - This Privacy Policy may be amended from time to time, and constitutes the entire agreement and understanding between Renovo Software and you with respect to Personally Identifiable Information, a Conference, the Site, the Software and the Services and supersedes all other prior or contemporaneous communications, agreements, understandings and proposals, whether written, oral, electronic or non-electronic, between Renovo Software and you regarding its subject matter.
    7. Electronic Signature(s) - By opening an account, using or accessing the Site, or by participating in a Conference, you agree to the terms of this Privacy Policy as may be amended from time to time and acknowledge that you have electronically signed and approved this Privacy Policy. You hereby agree to the use of electronic communication in order to enter into contracts, place Service Requests and create other records and to the electronic delivery of notices, policies and records of transactions initiated or completed through the Site. Furthermore, you hereby waive any rights or requirements under any laws or regulations which require an original (non-electronic) signature or delivery or retention of non-electronic records to the extent permitted under applicable law. We encourage you to print a copy of this Privacy Policy for your records.
  6. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS CONTAINED IN THIS PRIVACY POLICY, OR ANY UPDATES THERETO, DO NOT PARTICIPATE IN A CONFERENCE AND DO NOT ACCESS OR USE THE SITE, SERVICES, OR CONFERENCE CAPABILITIES THEREOF.
Renovo Software Refund Policy

All charges and credits will appear as "Inmate Services - Renovo Software" on the charge/debit card's statement. The credit/debit card will not be charged until the scheduled visitation time.

Cancelations:

If you cancel a visit prior to the start time, a charge may still apply. The total charge will appear in the Cancelation Confirmation window and on the summary page once you've confirmed the cancelation. Review the Cancelation/Refund policy on the summary page for details.

If the correctional facility cancels a visit as a result of the following actions, the visitor will not be charged for the visit. No transaction will appear on the visitor's credit/debit card's statement as a result of such cancelations.

Where to find the cancelation/refund information:

While Scheduling a Visit: On the pre-confirmation page prior to reserving a visit, the cancelation/refund policy is listed at the top of the page in a yellow dialog box. Once reserved the cancelation/refund policy will remain at top of the page in a yellow dialog box.

Currently Scheduled Visit: If you would like to review the cancelation/refund policy for a currently scheduled visit, on the home page under the "My Upcoming Visit" heading, click on any part of the visit's information other than "cancel" to open the summary page. On the summary page you can review the cancelation/refund policy. The cancelation/refund policy is listed at top of the page in a yellow dialog box.

Previously Completed or Canceled Visit: If you would like to review the cancelation/refund policy for a previously completed or canceled visit (within the last 6 months), under "My Account" select "View Visit History" and click on any part of the visit's information to open the summary page. The cancelation/refund policy is listed at top of the page in a yellow dialog box.
